How to let property in the UK

Letting out your property is a process which needs to be done right. Legislation must be followed, and the property must be managed correctly, or you could end up in trouble.

‍

Here are some of the key milestones to help landlords avoid any problems and let their property in the UK successfully.

‍

‍

Make sure your property is ‘fit for human habitation’

‍

Before you even think about letting your property, it needs to meet certain minimum standards and be ‘fit for human habitation’ under section 9A of the Landlord and Tenant Act 1985, which was inserted by the Homes (Fitness for Human Habitation) Act 2018.

‍

A property might fail these requirements if it:

  • Is in a state of disrepair
  • Is damp and mouldy
  • Has water or sanitation problems
  • Has health and safety hazards

‍

Once the standards have been achieved via any maintenance or repair work needed, you can move on and start the process of letting your property.

‍

‍

Drawing up a legal contract and gathering the right documentation

‍

This is arguably the most important step. Creating a contract in line with the Renter’s Rights Act is simple to do and follows some basic guidelines.

‍

It sets out obligations for you and your tenant during the lifetime of the tenancy.  Having a clearly drafted tenancy agreement ensures both parties understand these obligations. The standard tenancy type is known as the Assured Shorthold Tenancy.

‍

You will also need to provide the following documentation to your tenant:

  • Gas and electrical safety certificates
  • Energy Performance Certificates
  • How to Rent Checklist

‍

‍

Find a tenant

‍

Once you have all the documentation present and correct, you will need to find a tenant. That can be done by:

  • Advertising your property through property portals or other means
  • Holding viewings
  • Vetting potential tenants – Right to Rent checks, financial checks, referencing
  • Completing an inventory
  • Key handover

You will also need to take and protect a rental deposit with an approved Tenancy Deposit Scheme provider.

‍

All of those tasks are complicated, time consuming and often stressful. Letting a property is a big task and landlords can’t skip any of these steps.

‍

‍

Use a professional lettings and property management agent

‍

Alternatively, you could simply hand all of the tasks over to a professional lettings and property management agent. They will take care of all the paperwork and ensure your property and let is up to the required standard – now and in the future if legislation changes.

‍

They will also take care of all referencing, vetting and advertising needed to find the right tenant and get them into the property. Once they are there, the agent’s network of contacts can be called on to deal with any maintenance or repair issues which arise during the tenancy.

‍

Using the services of a professional is by far the easiest and most reliable way for landlords to let their property in the UK. It guarantees all of the benefits of being a landlord without any of the work or stress that can come with that position.
